Company Compliance and the HMRC

From time to time, the HRMC undertake company compliance reviews, they check employer’s records to ensure that employers have accounted for the right amount of PAYE and NICs at the right time, and that they have correctly completed form P11D. During the company compliance process they select an employer for a company compliance review for a variety of reasons. Having a company compliance review does not necessarily mean the employer has treated expense payments incorrectly or made incorrect returns.

During a Company Compliance review they will check:

  • PAYE and NICs is properly deducted and accounted for.
  • P11D form are correctly completed.
  • Travel expenses and benefits.
  • PAS  is correctly calculated.

Company Compliance and the HSE

Company compliance in regard health and safety law is enforced by inspectors from the Health and Safety Executive (HSE) or by inspectors from your local authority.

Inspectors have the right to enter any workplace without giving notice, and undertake a Company compliance check. On a normal company compliance inspection visit, an inspector would expect to look at the workplace, the work activities, your management of health and safety, and to check that you are complying with health and safety law.

During the Company compliance check, an inspector may offer guidance or advice to help you. They also talk to employees and their representatives, take photographs and samples, serve improvement notices and take action if there is a risk to health and safety which needs to be dealt with immediately. 


During a Company compliance review they will check

  • The business is registered
  • Employer’s liability insurance
  • The appointment of a competent person
  • The written health and safety policy
  • Any risk of harm to people 
  • Basic welfare facilities are provided
  • Health and Safety training and supervision
  • The Health and Safety law poster
