Redundancy and Lay-Off Redundancy and lay-off

Redundancy

Redundancy is when an employer reduces the workforce because a particular job or jobs are no longer required.

Redundancy situations may exist where the employer:

Intends to cease the work for which a worker was employed
Intends to cease work in the location at which a worker was employed
Has a reduced demand for work or expects it to cease or diminish.

Lay-off

Lay-off is where the employer asks

employees to stay at home or take leave when experiencing a reduced demand for work.

Short-time working

Short-time working is where the employer asks employee’s to work reduced hours.

Lay-off and short-time working situations may exist where the employer:
Intends to cease the work for which a worker was employed
Intends to cease work in the location at which a worker was employed
Has a reduced demand for work or expects it to cease or diminish.

There is no limit to the length of time an employee can be laid off or placed on short time working.  Most employees will be entitled to full pay unless their employment contract allows for a reduction.

Where any reduction in the workforce is unavoidable employers must select individuals on the basis of skills, qualifications and experience in a fair and consistent manner.
